A warning was given to two members who were very close to digging into the bank in an existing bear cave. Location: In the first feeder stream on the left side of the creek right before the first tailing area. I will be checking this area to see if activity continues after this warning was issued. Paragraph 2.B.6 of the CCPO Membership Guide states "There shall be no digging into the steep banks of the creek, even if the steep bank is below the high water mark. A steep bank is any bank rising more than 18" above the water level."

Rule clearly states "There shall be no cutting of trees or vegetation of any kind unless authorized and supervised by the PME Director.

Today, a member used a chainsaw to cut down two trees. These trees were growing on top of a bank that was recently dug under, which caused the bank to cave in and collapse. If you are caught digging under a bank or cutting down trees, you will be immediately suspended from the lease for 60 days. You will be escorted off the property. The local law enforcement will be contacted immediately should the need arise. Read the membership guide to review your membership status during the 60-day suspension. There is no tolerance for this kind of irresponsible behavior.

Over the Memorial Day weekend, some young men in a black 4x4 truck entered the property via the dirt access road. They attempted to steal a tractor and cart. After failing to start the tractor, they attempted to hook the tractor and trailer up to their truck. It was drug through the trail systems until finally dumped off. Butch was able to follow the tracks left by dragging the gear. The owner of the gear did confirm that it was in fact damaged, both tractor and trailer. A member spotted the truck as it left the property, identified as a black 4x4 truck with a silver or tin bedliner, like the diamond plate kind. The truck also had brush guards around the lights.

Reminder: We have no way of completely sealing off the entire property to those who choose to trespass. We are only leasing the creekbed and surrounding areas. If you leave gear down on the leased property or in sight of others using the roads and trails, you do so at your own risk. This is the first incident that we are aware of. Please remember to lock your vehicles in the parking area as well.

18.2-119
Trespassing
"If any person without authority of law goes upon or remains upon the lands, buildings or premises of another, or any portion or area thereof, after having been forbidden to do so, either orally or in writing, by the owner, lessee, custodian or other person lawfully in charge thereof, or after having been forbidden to do so by a sign or signs posted by such persons or by the holder of any easement or other right-of-way authorized by the instrument creating such interest to post such signs on such lands, structures, premises or portion or area thereof at a place or places where it or they may be reasonably seen, or if any person, whether he is the owner, tenant or otherwise entitled to the use of such land, building or premises, goes upon, or remains upon such land, building or premises after having been prohibited from doing so by a court of competent jurisdiction by an order issued pursuant to §§ 16.1-253, 16.1-253.1, 16.1-253.4, 16.1-278.2 through 16.1-278.6, 16.1-278.8, 16.1-278.14, 16.1-278.15, 16.1-279.1, 19.2-152.8, 19.2-152.9 or § 19.2-152.10 or an ex parte order issued pursuant to § 20-103, and after having been served with such order, he shall be guilty of a Class 1 misdemeanor. This section shall not be construed to affect in any way the provisions of §§ 18.2-132 through 18.2-136."

Entering property to cause damage
"It shall be unlawful for any person to enter the land, dwelling, outhouse or any other building of another for the purpose of damaging such property or any of the contents thereof or in any manner to interfere with the rights of the owner, user or the occupant thereof to use such property free from interference. Any person violating the provisions of this section shall be guilty of a Class 1 misdemeanor. However, if a person intentionally selects the property entered because of the race, religious conviction, color or national origin of the owner, user or occupant of the property, the person shall be guilty of a Class 6 felony, and the penalty upon conviction shall include a term of confinement of at least six months, 30 days of which shall be a mandatory minimum term of confinement."

Refusal of person on land of another to identify himself
"Any person who goes on the lands, waters, ponds, boats or blinds of another to hunt, fish, or trap and willfully refuses to identify himself when requested by the landowner or his agent so to do shall be deemed guilty of a Class 4 misdemeanor."

Trespassing on posted property
"Any person who goes on the lands, waters, ponds, boats or blinds of another, which have been posted in accordance with the provisions of § 18.2-134.1, to hunt, fish or trap except with the written consent of or in the presence of the owner or his agent shall be guilty of a Class 1 misdemeanor."

"Any person who shall mutilate, destroy or take down any "posted," "no hunting" or similar sign or poster on the lands or waters of another, or who shall post such sign or poster on the lands or waters of another, without the consent of the landowner or his agent, shall be deemed guilty of a Class 3 misdemeanor"

Destruction of trees, shrubs, etc.
"It shall be unlawful for any person to pick, pull, pull up, tear, tear up, dig, dig up, cut, break, injure, burn or destroy, in whole or in part, any tree, shrub, vine, plant, flower or turf found, growing or being upon the land of another, or upon any land reserved, set aside or maintained by the Commonwealth as a public park, or as a refuge or sanctuary for wild animals, birds or fish, or upon any land reserved, set aside or maintained as a public park by a park authority created under the provisions of § 15.2-5702, without having previously obtained the permission in writing of such other or his agent or of the superintendent or custodian of such park, refuge or sanctuary so to do, unless the same be done under the personal direction of such owner, his agent, tenant or lessee or superintendent or custodian of such park, refuge or sanctuary. Any person violating this section shall be guilty of a Class 3 misdemeanor; provided, however, that the approval of the owner, his agent, tenant or lessee, or the superintendent or custodian of such park or sanctuary afterwards given in writing or in open court shall be a bar to further prosecution or suit."
